1. Acceptance of Terms

By accessing or using Hylaq ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Hylaq provides a handle-based internet navigation system, non-custodial digital wallet services, and cryptocurrency payment functionality. The Service allows users to register @handles, create wallets, and send/receive digital assets including USDC, SOL, BTC, ETH, and BNB.

3. Non-Custodial Wallet

Hylaq wallets are non-custodial. This means:

  • You are solely responsible for securing your recovery phrase
  • We cannot recover lost or stolen funds
  • We cannot reverse transactions once confirmed on the blockchain
  • You maintain full control and ownership of your assets

4. Fees

The following fees apply to transactions:

  • USDC to USDC transfers: FREE (gas sponsored)
  • Native payments (Solana USDC/SOL): 0.1% + swap spread
  • Non-native payments (ETH, BNB, BTC): 0.5% + network fees
  • Swap spread markup: 0.2% on swap transactions

Fees are collected in USDC and sent to our sponsor wallet. Additional network fees may apply depending on blockchain congestion.

5. User Responsibilities

You agree to:

  • Provide accurate information during registration
  • Maintain the security of your account and recovery phrase
  • Not use the Service for illegal activities including money laundering
  • Comply with all applicable laws and regulations
  • Not attempt to manipulate or exploit the Service

6. Prohibited Activities

The following activities are strictly prohibited:

  • Fraud, money laundering, or terrorist financing
  • Purchasing illegal goods or services
  • Circumventing security measures
  • Impersonating others or creating misleading handles
  • Using automated systems to abuse the Service

7. Intellectual Property

All content, trademarks, and intellectual property associated with Hylaq are owned by Hylaq or its licensors. Your @handle registration grants you a limited, non-exclusive license to use that handle within the Hylaq ecosystem.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy of price quotes or exchange rates
  • Compatibility with all devices or browsers
  • Protection against all security threats

9. Limitation of Liability

To the maximum extent permitted by law, Hylaq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or digital assets, regardless of the cause of action or the theory of liability.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, you may still access your funds through the blockchain directly using your recovery phrase.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
